Management summary research study „Developing preventive pre-insolvency and insolvency-restructuring processes at companies facing financial problems; possibility of increasing the use and success rate of such processes by establishing an EVS and by laying down preventive-restruc. methods “

The project analyzed financial (economic) and legal reasons why revitalization solutions are employed by less than 1% of companies that face insolvency and go bankrupt. Further, the project team created a mechanism of early-warning systems (EWS) that includes the debtor´s (or its management´s) accounting and audit obligation as the key precondition for starting a preventiverestructuring process attended by relevant third parties such as financial (tax) authorities and social security agencies.

The team compared EWS in relevant EU countries and lay down preventive-restructuring methods (legislative) designed to enable debtors to restructure their companies in the early stages in order to prevent bankruptcy and liquidation.
